An Act

to create
101.02 (26) of the statutes;
relating to:
applicability of the

commercial building code to certain buildings.
Analysis by the Legislative Reference Bureau
Under this bill, the commercial building code rules promulgated by the Department of Safety and Professional Services and in effect on August 1, 2025, apply to a public building, public structure, or place of employment if the plans for the public building, public structure, or place of employment are submitted for examination for compliance with the commercial building code no later than April 1, 2026. Before September 1, 2025, DSPS’s commercial building code rules incorporated by reference the 2015 International Building Code; however, effective September 1, 2025, the commercial building code rules incorporate by reference the 2021 International Building Code.
Because this bill may increase or decrease, directly or indirectly, the cost of the development, construction, financing, purchasing, sale, ownership, or availability of housing in this state, the Department of Administration, as required by law, will prepare a report to be printed as an appendix to this bill.
For further information see the state and local fiscal estimate, which will be printed as an appendix to this bill.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

361.03 (7), Wis. Adm. Code, does not apply to the public building, public structure,

or place of employment if the plans of the public building, public structure, or place
6
of employment are submitted to the department or, if the city, village, town, or
7
county within which the public building, public structure, or place of employment is
8
to be located is authorized to perform examinations under s. 101.12, that city,
9
village, town, or county, no later than April 1, 2026.
