An Act

to amend
301.45 (4) (b);
to create
301.48 (2) (e) of the statutes;

relating to:
tracking a person who is registered as a sex offender but unable
3
to provide an address.
Analysis by the Legislative Reference Bureau
Under current law, a person who has been convicted of certain sex offenses, found not guilty by reason of mental disease or defect of certain sex offenses, or found to be a sexually violent person must register with the Department of Corrections as a sex offender, and certain of these registrants are tracked using a global positioning system monitored by DOC. Current law requires all registrants to provide an address. Under this bill, if a registrant is unable to provide an address, the registrant must be tracked using a GPS system monitored by DOC.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

301.45 (4) (b) of the statutes is amended to read:

(b) If the person is on parole or extended supervision and the

person knows that any of the information under sub. (2) (a) 5. will be changing, the
1
person shall provide the department with the updated information before the
2
change in his or her address occurs. If the person is on parole or extended
3
supervision and any of the information under sub. (2) (a) 5. changes but the person
4
did not know before the change occurred that his or her address would be changing,
5
the person shall provide the department with the updated information within 24
6
hours after the change in his or her address occurs.
If the person is on parole or
7
extended supervision and is unable to provide an address, the person shall notify
8
the department within 24 hours after the person becomes no longer able to provide
9
an address.

(e) If a person who is subject to the reporting requirements under

s. 301.45 but who is not subject to tracking under this section is unable to provide

an address as required under s. 301.45 (2) (a) 5., the department shall have the

person tracked using passive positioning system tracking.
