An Act

to create
283.90 of the statutes;
relating to:
notifying counties and

tribes of an exceedance of groundwater protection standards or standards for

PFAS.
Analysis by the Legislative Reference Bureau
Under this bill, if the Department of Natural Resources finds that there has been an exceedance of groundwater standards or of any standard for perfluoroalkyl or polyfluoroalkyl substance (commonly known as PFAS) in a proposed or promulgated DNR rule, DNR must notify the county health department, tribal health department, and county land and conservation department in the affected county. DNR must also notify the county health department, tribal health department, and county land and conservation department in any adjacent county that DNR determines may be negatively affected by the exceedance. The bill requires DNR to provide these notices within seven business days after verifying that an exceedance has occurred. The bill also requires DNR to create and maintain a notification system for notifying county health departments, tribal health departments, and county land and conservation departments of the types of exceedances that trigger the notice requirement.

Notification of exceedances.

(1)
Whenever on the basis of any

information available to it the department finds that there has been a exceedance of
4
any groundwater protection standards under ch. 160 or of any standard for PFAS,
5
as defined in s. 299.48 (1) (b), in a proposed or promulgated rule of the department,
6
the department shall notify the county health department, tribal health
7
department, and county land and conservation department in the affected county
8
and the county health department, tribal health department, and county land and
9
conservation department in any adjacent county that the department determines
10
may be negatively affected as a result of the exceedance.

The department shall

provide notice within 7 business days after verifying that an exceedance has
12
occurred. The notice is subject to public inspection and copying under s. 19.35 (1).
