An Act

to create
157.06 (15m) of the statutes;
relating to:
prohibiting

knowingly covering organ transplantation and related care under health
3
insurance policies and the Medical Assistance program if the organ is
4
transplanted in or originates from a country known to have participated in
5
forced organ harvesting.
Analysis by the Legislative Reference Bureau
This bill prohibits health insurance policies and plans, including self-insured governmental plans, and the Medical Assistance program from knowingly covering a human organ transplant or posttransplant care if the transplant operation is performed in or the human organ to be transplanted was procured by sale or donation originating in the People’s Republic of China or in another country, as designated by the Department of Health Services, known to have participated in forced organ harvesting. However, the bill does not prohibit any posttransplant service or care provided to save the life of an individual after the individual receives a human organ transplant that is prohibited under the bill. The bill defines “forced organ harvesting” as the removal of one or more organs from a living person, by means of coercion, abduction, deception, fraud, or abuse of power over a position of vulnerability, or from a person killed for the purpose of removal of one or more organs. Under the bill, DHS may designate a country whose government funds, sponsors, or otherwise facilitates forced organ harvesting to be included in the prohibition. The Medical Assistance program is a joint federal and state program that provides health services to individuals who have limited financial resources.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

(a) In this subsection, “forced organ

harvesting” means the removal of one or more organs from a living person, by
5
means of coercion, abduction, deception, fraud, or abuse of power over a position of
6
vulnerability, or from a person killed for the purpose of removal of one or more
7
organs.

(b) Subject to par. (c), no payer to which this subsection applies under par. (e)

may knowingly cover a human organ transplant or posttransplant care if any of the
10
following apply:

1. The transplant operation is performed in the People’s Republic of China or
12
in another country known to have participated in forced organ harvesting, as
13
designated by the department under par. (d).

2. The human organ to be transplanted was procured by sale or donation

participated in forced organ harvesting, as designated by the department under

(c) Paragraph (b) does not apply to any posttransplant service or care provided

For policies and plans containing provisions inconsistent with this act, this

act first applies to policy or plan years beginning on the effective date of this

subsection, except as provided in sub. (

policy or plan years beginning on the effective date of this subsection or on the day
