An Act
to create
94.706 of the statutes;
relating to:
prohibiting
2
noncommercial uses of neonicotinoid pesticides.
Analysis by the Legislative Reference Bureau
Current law requires the Department of Agriculture, Trade and Consumer Protection to regulate the sale and use of certain pesticides, which include insecticides and herbicides, but does not require DATCP to regulate neonicotinoid pesticides.
This bill prohibits the use of neonicotinoid pesticides on outdoor ornamental plants, trees, or turf that are grown for a noncommercial use, unless the application is made as part of a tree injection, is done by a certified applicator, or is done during the production of an agricultural commodity. An “agricultural commodity” is defined under current law as any plant, animal, or animal product produced primarily for sale, consumption, propagation, or other use by humans or animals.
A person who violates the prohibition under the bill is subject to the penalties under current law for violating laws regulating other pesticides, which are a civil forfeiture of $100 to $500 for the first violation and $200 to $1,000 for any subsequent violation within five years.
