tort.
Analysis by the Legislative Reference Bureau
Under current law, the procedure for pursuing civil actions in small claims is the exclusive procedure for third-party complaints, personal injury claims, and actions based in tort if the amount claimed is $5,000 or less. The small claims procedure is also the exclusive procedure for pursuing other civil actions for claims that are $10,000 or less, if the actions are for money judgments or garnishments or to enforce a lien. This bill increases the jurisdictional limit for actions in small claims for third-party complaints, personal injury claims, and actions based in tort from $5,000 or less to $10,000 or less.
