An Act

to create
59.42 (4) of the statutes;
relating to:
office of county board

counsel in certain counties.
Analysis by the Legislative Reference Bureau
This bill creates the office of board counsel in any county that employs a corporation counsel and that has a county executive or county administrator. Board counsel is appointed by the county board and serves at the pleasure of the county board. Board counsel is independent of the corporation counsel and provides advice and legal service to the county board.
For further information see the local fiscal estimate, which will be printed as an appendix to this bill.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

59.42 (4) of the statutes is created to read:

Board counsel.
In any county that employs a corporation counsel,

including a corporation counsel jointly designated by 2 or more counties, and that

has a county executive or county administrator, there is created, independent of the
1
corporation counsel, the office of board counsel. Board counsel is appointed by the
2
county board and serves at the pleasure of the county board. Board counsel and any
3
deputy board counsels shall be attorneys at law licensed in this state. The duties of
4
board counsel are to provide advice and legal service to the county board. The
5
board may leave the office of board counsel unfilled at the pleasure of the board.
