An Act

to renumber and amend
69.14 (1) (h);
to create
69.14 (1) (h) 2. of the

statutes;
relating to:
registration of births by surrogate mother.
Analysis by the Legislative Reference Bureau
Under current law, if a child is born to a surrogate mother, information about the surrogate mother must be entered on the child’s birth record and information about the father must be omitted from the birth record. If a court determines parental rights over the child, the clerk of court must report the court’s determination to the state registrar, who must prepare and register a new birth record and send notice to the local registrar who filed the original record to have the replaced record destroyed.
Under this bill, a court may not determine parental rights over a child born to a surrogate mother unless at least one individual petitioning for parental rights is biologically related to the child.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

(h) 1. If the registrant of a birth record under this section is born to

a surrogate mother, information about the surrogate mother shall be entered on the
3
birth record and the information about the father shall be omitted from the birth
4
record.

a court determines parental rights over the

registrant, the clerk of court shall report the court’s determination to the state
6
registrar on a form prescribed by the state registrar, along with the fee required
7
under s. 69.22. Upon receipt of the report, the state registrar shall prepare and
8
register a new birth record for the registrant under s. 69.15 (6) and send notice of
9
the new record to the local registrar who filed the original record. Upon receipt of
10
the notice, the local registrar shall destroy his or her copy of the replaced record.
