to amend
29.753 (intro.) and 29.753 (3);
to create
95.23 (5) and 95.55

(6) (c) of the statutes;
relating to:
prohibiting the quarantine of certain

animals based on exposure to chronic wasting disease.
Analysis by the Legislative Reference Bureau
Currently, the Department of Agriculture, Trade and Consumer Protection has the authority to quarantine farmed animals if it suspects an animal is infected with chronic wasting disease (CWD).
This bill prohibits DATCP from ordering the quarantine of an animal that belongs to a species that is known to neither carry nor be susceptible to CWD, including deer belonging to the species
Dama dama,
based solely on an incident of the animal having been exposed to CWD. Deer in the
Dama dama
species are commonly referred to as “fallow” deer.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

(intro.) Notwithstanding ss. 95.20 and

(a) and (b)
and rules promulgated under those provisions, the department

may import and move elk and introduce the elk into Ashland, Bayfield, Jackson,

Price, or Sawyer county if all of the following apply:
