An Act

to amend
227.22 (2) (intro.) and 227.24 (1) (c) of the statutes;
relating

the effective date of administrative rules and the effective period of

emergency rules.
Analysis by the Legislative Reference Bureau
Under current law, a permanent administrative rule that has been filed for publication generally takes effect on the first day of the month commencing after the date of final publication of the rule in the administrative register, unless a later date is prescribed by the agency. This bill changes the default effective date for permanent administrative rules to the first day of the seventh month commencing after the date of final publication of the rule in the administrative register. As under current law, the agency may also prescribe a later effective date than the default effective date.
Also under current law, an agency may promulgate a rule as an emergency rule without complying with certain requirements that apply to permanent rules if preservation of the public peace, health, safety, or welfare necessitates putting the rule into effect prior to the time it would take effect if the agency complied with the requirements for permanent rules. An emergency rule, however, remains in effect only for 150 days, subject to extension by the Joint Committee for Review of Administrative Rules (JCRAR). The bill extends the initial effective period of an emergency rule to 180 days, subject to extension by JCRAR.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:
