AN ACT relating to environmental quality; providing an air quality exemption for agricultural burning; and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

Activities not subject to regulation.

(a)

The following are not subject to regulation under this article or of any rules made thereunder:

(i)

Burning incident to horticultural or agricultural operation of:

(A)

Prunings from trees, bushes and plants; or

(B)

Dead or diseased trees, bushes and plants, including stubble.

(ii)

Burning weed growth in and along ditch banks incident to clearing ditches for irrigation purposes;

(iii)

Burning fence lines;

(iv)

Burning rangeland to enhance wildlife and livestock habitat.

Definitions.

(b)

Specific definitions applying to air quality:

(vii)

"Agricultural operation" means any facility for the production for commercial purposes of crops, livestock, poultry, livestock products or poultry products.

Section 3.

The department of environmental quality shall report to the joint agriculture, public lands and water resources committee regarding the status of burning rules and regulations by July 1, 2005.
