Subject: Requires courts to prohibit release of minor victims' names, except as specified. Summary/Major Elements: Under current law, a court may restrict the disclosure or publication of information that is reasonably likely to identify the minor victim upon request of the minor victim or another acting on behalf of a victim, if an information or indictment has been filed in a criminal matter. This bill requires a court to restrict the disclosure or publication of information that is reasonably likely to identify the minor victim, if an information or indictment has been filed in a criminal matter, unless the minor victim or another acting on behalf of the minor requests the release of the identifying information.
WORKING DRAFT ORIGINAL HOUSE BILL NO. 0060 ENROLLED ACT NO. 82, HOUSE OF REPRESENTATIVES FIFTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING 2005 GENERAL SESSION AN ACT relating to crimes and offenses; requiring courts to prohibit release of minor victims' names to protect the welfare of the minor child except as specified; amending definition of "minor victim" for purposes of releasing information regarding certain offenses; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1. W.S. 6 ‑ 2 ‑ 310(b), 6 ‑ 4 ‑ 402(d), 6 ‑ 4 ‑ 403(g) and (k) and 14 ‑ 3 ‑ 106(b) are amended to read: 6 ‑ 2 ‑ 310. Names not to be released; restrictions on disclosure or publication of information; violations; penalties; effect of disclosure; "minor victim". (b) After the filing of an information or indictment and upon the absent a request to release the identity of a minor victim by the victim or another acting on behalf of a minor victim, the trial court may, to the extent necessary to protect the welfare of the minor victim, shall restrict the disclosure or publication of information reasonably likely to identify the minor victim. 6 ‑ 4 ‑ 402. Incest; penalties; disclosure or publication of identifying information; "minor victim". (d) After the filing of an information or indictment and upon the absent a request to release the identity of a minor victim by the victim or another acting on behalf of a minor victim, the trial court may, to the extent necessary to protect the welfare of the minor victim, shall restrict the disclosure or publication of information reasonably likely to identify the minor victim. 6 ‑ 4 ‑ 403. Abandoning or endangering children; penalties; "child"; disclosure or publication of identifying information; "minor victim". (g) After the filing of an information or indictment and upon the absent a request to release the identity of a minor victim by the victim or another acting on behalf of a minor victim, the trial court may, to the extent necessary to protect the welfare of the minor victim, shall restrict the disclosure or publication of information reasonably likely to identify the minor victim. (k) As used in subsection (g) of this section, "minor victim" means a person under the age of sixteen (16) eighteen (18) years. 14 ‑ 3 ‑ 106. Names not to be released; restrictions on disclosures or publication of information; violations; penalties. (b) After the filing of an information or indictment and upon the absent a request to release the identity of a minor victim by the victim or another acting on behalf of a minor victim, the trial court may, to the extent necessary to protect the welfare of the minor victim, shall restrict the disclosure or publication of information reasonably likely to identify the minor victim. Section 2. This act is effective July 1, 2005.
