Subject: Allowable exclusions from life insurance coverage for military service. Summary/Major Elements: Current law allows life insurance policies to exclude coverage for deaths resulting from any cause while serving in the military, if the country is engaged in military action. This bill allows the exclusion only if the death results from an act of war or hazard of war. The act applies to policies issued, renewed or delivered for issuance after its effective date.
WORKING DRAFT ORIGINAL HOUSE BILL NO. 0067 ENROLLED ACT NO. 21, HOUSE OF REPRESENTATIVES FIFTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING 2005 GENERAL SESSION AN ACT relating to insurance; prohibiting exclusions from coverage for military actions and military service in individual life insurance policies as specified; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1. W.S. 26-16-119(a)(ii)(A) and (C) is amended to read: 26-16-119. Provisions limiting liability in life insurance policies prohibited; exceptions. (a) No life insurance policy shall be delivered or issued for delivery in this state if it contains any provision: (ii) Which excludes or restricts liability for death caused in a certain specified manner or occurring while the insured has a specified status, except that a policy may contain provisions excluding or restricting coverage as specified therein in case of death under any of the following circumstances: (A) Death as a result, directly or indirectly, of war, declared or undeclared, or of action by military forces, or of any act or hazard of a war or action ; , or of service in the military, naval or air forces or in civilian forces auxiliary thereto, or from any cause while a member of the military, naval or air forces of any country at war, declared or undeclared, or of any country engaged in military action; (C) Death as a result of a specified hazardous occupation . Service in the military, naval or air forces or in civilian forces auxiliary thereto shall not be a specified hazardous occupation under this subparagraph ; Section 2. This act applies to insurance policies issued, renewed, delivered or issued for delivery in this state on or after the effective date of this act. Section 3. This act is effective immediately upon co m pletion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constit u tion.
