Summary/Major Elements: Current law requires the department of health to license health care facilities, including assisted living facilities. Regulations of the department prohibit assisted living facilities from having secured units, which are necessary for memory-impaired patients. This act authorizes assisted living facilities to have secured units to care for patients with Alzheimer's disease or other dementia conditions.
WORKING DRAFT ORIGINAL HOUSE BILL NO. 0109 ENROLLED ACT NO. 71, HOUSE OF REPRESENTATIVES FIFTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING 2005 GENERAL SESSION AN ACT relating to health care facilities and services; authorizing assisted living facilities to care for memory impaired persons as specified; amending a definition; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1. W.S. 35 ‑ 2 ‑ 901(a)(xxii) is amended as follows: 35 ‑ 2 ‑ 901. Definitions; applicability of provisions. (a) As used in this act: (xxii) "Assisted living facility" means a dwelling operated by any person, firm or corporation engaged in providing limited nursing care, personal care and boarding home care, but not habilitative care, for persons not related to the owner of the facility . This definition may include facilities with secured units and facilities dedicated to the special care and services for people with Alzheimer's disease or other dementia conditions ; Section 2. This act is effective July 1, 2005.
