A BILL

for

AN ACT relating to government reorganization; creating a department of tourism and recreation; specifying department components; requiring a report; providing for the subsequent reorganization of the department; and providing for effective dates.

Department of tourism and recreation created; director appointed; structure.

(a)

As part of the reorganization of Wyoming state government, there is created the Wyoming department of tourism and recreation. The provisions of the Wyoming Government Reorganization Act of 1989, W.S. 9

1708, apply to this section, except the requirement under W.S. 9

‑
1707(a)(iii) that public hearings regarding the reorganization plan required under subsection (b) of this section be conducted by at least two (2) interim committees of the legislature shall not apply.

(b)

The administrative head of the department shall be a director appointed by the governor not later than April 1, 2005. The director shall prepare a plan for reorganization of the agencies, programs and functions specified in this section and submit it to the governor for approval. The department reorganization plan, as approved by the governor, shall be submitted to the joint travel, recreation, wildlife and cultural resources interim committee no later than October 15, 2005 and made available to the public. The committee shall hold at least one (1) public hearing regarding the plan before the 2006 budget session of the legislature convenes. The joint travel, recreation, wildlife and cultural resources interim committee shall report to the legislature by December 1, 2005, its recommendations on the plan, including necessary legislation with respect to the plan. The plan, as approved by the act of the legislature, shall be implemented not later than July 1, 2006.

(c)

The department reorganization plan shall consider whether the following functions or programs are assigned from or to the agency or department under a Type 2 transfer:

PROGRAM; FROM; TO

(i)

Wyoming tourism board; Business council; Tourism and recreation;

(ii)

State trails program; State parks and cultural resources; Tourism and recreation.

(d)

As used in this section:

(i)

"Business council" means the Wyoming business council created by W.S. 9

(ii)

"State parks and cultural resources" means the department of state parks and cultural resources created by W.S. 9

2017;

(iii)

"Tourism and recreation" means the department of tourism and recreation created by this act.

(e)

In developing the plan required under W.S. 9

‑
1707(a)(iii), the director shall consider:

(i)

The cost-effectiveness of any recommended transfer;

(ii)

Whether the transfer will result in a more efficient provision of services to customers;

(iii)

The benefit that the recommended transfer would create with respect to attracting tourists to Wyoming to partake in the recreational activities available within the state;

(iv)

The benefit that the recommended transfer would have in expanding the scope of activities available from, and duties of, the state trails program;

(v)

The benefit that would result from the department of tourism and recreation overseeing and developing long range planning of recreation policy in the state, including working with the United States forest service and the federal bureau of land management in a cooperative agency status.

As used in this act:

(a)

Pursuant to this act and other laws establishing individual departments, the entire executive branch of state government shall be organized into not more than

principal departments except for the offices of the following officials and except as provided in subsections (d), (e) and (f) of this section:

Section 4.

(a)

Except as provided in subsection (b) of this section, this act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.

(b)

Section 3 of this act is effective July 1, 2006.
