A BILL

for

AN ACT relating to public records; providing that autopsy records shall not be released without court order; and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

Section 1.

203(d)(i) and by creating a new paragraph (xiii) is amended to read:

Right of inspection; grounds for denial; access of news media; order permitting or restricting disclosure; exceptions.

(d)

The custodian shall deny the right of inspection of the following records, unless otherwise provided by law:

(i)

Medical, psychological and sociological data on individual persons
;
, exclusive of coroners' autopsy reports;

(xiii)

Any autopsy records, documents, evidence or pictures, including instant photographs and videotapes of the body, or any portion of the body, of a deceased person, taken by or for a coroner at the scene of death or in the course of a postmortem examination or autopsy made by or caused to be made by the coroner, except:

(A)

When used in a criminal action or proceeding in this state which relates to the death of that person; or

(B)

For use as a court of this state permits, by order after good cause has been shown and after written notification of the request for the court order has been served at least five (5) days before the order is made upon the coroner for the county in which the postmortem examination or autopsy occurred; or

(C)

For use by any law enforcement agency in this state or any other state or federal law enforcement agency.

Section 2.
This act is effective July 1, 2005.
