A BILL

for

AN ACT relating to eluding police vehicles; prohibiting the operation of a vehicle in a reckless manner while eluding an officer as specified; imposing penalties; providing for mandatory license revocation; and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

Fleeing or attempting to elude police officers; eluding officer when operating vehicle with disregard for safety of others; penalties; license revocation.

(b)

Any driver of a motor vehicle who drives or operates the vehicle in willful or wanton disregard of the safety of persons or property while fleeing or eluding a pursuing police vehicle is guilty of a felony.

shall be punished by a fine of not more than seven hundred fifty dollars ($750.00),
or
by imprisonment for not more than ninety (90) days, or both.

(d)

Any person convicted of a violation of subsection (b) of this section shall be fined not more than five thousand dollars ($5,000.00), imprisoned for not less than one (1) year nor more than three (3) years, or both.

(e)

Any person convicted of a violation of subsection (b) of this section shall, in addition to the penalties imposed by this section, have his driver's license revoked pursuant to W.S. 31

Reckless driving.

Except under circumstances constituting a violation of W.S. 31

225(b), a
ny person who drives any vehicle in willful or wanton disregard for the safety of persons or property is guilty of reckless driving.

Mandatory revocation of license for certain violations.

(a)

The division shall revoke the license or nonresident operating privilege of any person, upon receipt of a record of conviction of the person of any of the following violations:

Section 2.
This act is effective July 1, 2005.
