Be It Enacted by the Legislature of the State of Wyoming:

104 by creating a new subsection (e) is amended to read:

Powers and duties of department of health.

(e)

Notwithstanding any programs the department may implement requiring the use of prior authorization or a preferred drug list, the department shall pay for any drug prescribed by a prescribing practitioner if the prescribing practitioner has written "brand medically necessary" on the face of the prescription when the drug is for a qualified recipient of medical assistance under this chapter.

Section 2.

This act is effective July 1, 2005.
