Sponsored by: Select Committee on Capital Financing and Investments A BILL for AN ACT relating to the administration of government; providing for a secretary to the state building commission; specifying duties; providing for recommendations of the state building commission to be reflected in the proposed state budget; transferring a position and associated budget; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1. W.S. 9 ‑ 2 ‑ 1013(d)(i), 9 ‑ 5 ‑ 101 by creating a new subsection (d) and 9 ‑ 5 ‑ 106(b) are amended to read: 9 ‑ 2 ‑ 1013. State budget; distribution of copies to legislators; copies and reports of authorizations. (d) In addition to the items contained in subsection (a) of this section and notwithstanding any other recommendations made by the governor, the state budget shall also include the governor's recommendations for appropriations for the ensuing two (2) years, or if a supplemental budget request, the remainder of the budget period, subject to the following: (i) The state budget shall include the governor's recommendations for a total appropriation from the school foundation program account and based upon recommendations of the school facilities commission under W.S. 21 ‑ 15 ‑ 119, a total appropriation for school capital construction purposes for both fiscal years . The state budget shall include the state building commission's and governor's recommendations for appropriations for state capital construction based upon the needs assessment and construction schedule under W.S. 9 ‑ 5 ‑ 107 and 9 ‑ 5 ‑ 108 for both fiscal years ; 9 ‑ 5 ‑ 101. State building commission; composition; general powers and duties; conflicts of interest. (d) The state building commission shall employ a secretary who shall administratively implement any rules of the commission adopted under this article and perform other duties and functions of the commission as may be assigned by the commission. The secretary of the commission shall be employed upon a majority vote of the commission and serve at the pleasure of a majority of the commission. The commission shall establish compensation for its secretary subject to legislative budget authorization. 9 ‑ 5 ‑ 106. State building commission; powers relative to use of state buildings; rules authorized; exceptions. (b) The secretary to the commission under W.S. 9 ‑ 2 ‑ 1016(b)(xxi) shall administratively implement any rules of the state building commission adopted under this section. The director of the department of administration and information may adopt rules and regulations which make violation of rules adopted by the commission under subsection (a) of this section grounds for disciplinary action for any state employee violating the rules of the state building commission regarding operation, management or use of state buildings. Section 2. W.S. 9 ‑ 2 ‑ 1016(b)(xxi) is repealed. Section 3. The position of the manager of the construction management section within the authorized budget of the department of administration and information together with the remaining budget associated for that position for the fiscal biennium ending June 30, 2008 shall be transferred to the state building commission. The position shall act as secretary to the commission in accordance with this act. Section 4. This act is effective January 1, 2007. (END) 1 HB0149
