AN ACT relating to outfitters and professional guides; providing for assessment of civil penalties as specified; and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

License suspension and revocation; grounds; payment of damages; civil penalties; proceedings.

(e)

If an outfitter or professional guide licensed under this act is accused of any of the actions specified in subsection (a) of this section, the board may assess a civil penalty of not more than two thousand dollars ($2,000.00) and may impose a probationary period under terms and conditions, a violation of which shall result in revocation or suspension of the license, for each action if:

(i)

The outfitter or professional guide admits the action or the board, after a hearing in accordance with the Wyoming Administrative Procedure Act, finds clear and convincing evidence the action occurred; and

(ii)

The board finds that suspension or revocation of the license are not appropriate remedies.

(f)

Penalties provided under subsection (e) of this section shall be paid into the county treasury to the credit of the public school fund of the county in which the violation occurred.

Violations in general; penalties.

(a)

In addition to any penalties assessed pursuant to W.S. 23

a
ny person violating any provision of this act is guilty of a misdemeanor punishable by a fine of not to exceed two thousand dollars ($2,000.00), imprisonment for not more than one (1) year, or both.

Section 2.

It is the intent of the legislature that the penalties provided in this act are of a civil nature only and are in addition to any criminal penalties available under Wyoming statute.

Section 3.
This act is effective July 1, 2005.
