A BILL

for

AN ACT relating to special education programs and services; providing an appropriation for a position within the department of education to implement recommendations of the special education regionalization study task force; and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

Section 1.

(a)

One hundred thousand dollars ($100,000.00) is appropriated from the general fund to the state superintendent of public instruction to fund one (1) additional full-time position to implement recommendations of the regionalization service study task force appointed by the state superintendent to carry out a study to implement a regionalized approach for the provision of special education programs and services, as required by 2003 Wyoming Session Laws, Chapter 208, Section 103(b). Responsibilities for this position shall include:

(i)

Development of statewide guidelines for adequate special education staffing levels for use in assessing special education programs and services provided by school districts, as required by W.S. 21

(ii)

Monitoring of school district staffing levels and special education identification and service delivery practices, as required under W.S. 21

202(a)(xxiv);

(iii)

Establishment and administration of the regionalized services center board recommended by the task force, to govern a center functioning as a clearinghouse for determining district staffing needs and guidelines, locating, acquiring and retaining special education service providers and personnel, and collaborating with school districts for provision or supervision of service providers and personnel;

(iv)

Assessment of the appropriateness of district variations in services provided or the delivery of services, and development of alternative approaches to districts for program and service delivery, as required under W.S. 21

202(a)(xxiv).

(b)

On or before October 15, 2005, the state superintendent shall report to the joint education interim committee on the position funded under this section and on the execution of position responsibilities specified under subsection (a) of this section.
