Sponsored by: Representative(s) Martin, Barnard, Gilmore, Hastert, Walsh and Watt and Senator(s) Sessions A BILL for AN ACT relating to the Wyoming retirement system; authorizing municipal animal control and community service officers to participate in the law enforcement retirement system; amending a definition; permitting employers to pay the difference between coverage under the retirement system and the law enforcement retirement system for municipal animal control and community service officers; conditioning implementation upon receipt of required payments and transfer of covered animal control and community service officers as specified; providing for funding; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1. W.S. 9 ‑ 3 ‑ 402(a)(xviii) and 9 ‑ 3 ‑ 432(b) are amended to read: 9-3-402. Definitions. (a) As used in this article: (xviii) "Law enforcement officer" or "officer" means any member who is a county sheriff, deputy county sheriff, municipal police officer, duly authorized investigator of the Wyoming livestock board meeting the specifications of W.S. 7 ‑ 2 ‑ 101(a)(iv)(E), investigator employed by the Wyoming state board of outfitters and professional guides meeting the specifications of W.S. 7 ‑ 2 ‑ 101(a)(iv)(J), Wyoming correctional officer, Wyoming law enforcement academy instructor, University of Wyoming campus police officer, detention officer or dispatcher for law enforcement agencies . Law enforcement officer also includes municipal animal control or community services officers when the municipal employer and employee have agreed to fund benefits provided to law enforcement officers under W.S. 9-3-432 ; 9 ‑ 3 ‑ 432. Law enforcement officers; contributions; benefit eligibility; service and disability benefits; death benefits; benefit options. (b) Except as otherwise provided, e ach employer of a law enforcement officer covered under this article shall pay into the account a contribution equal to eight and six-tenths percent (8.6%) of the salary paid to each of its law enforcement officers covered under this article and may pay into the account any amount of the officer's share of contributions under subsection (a) of this section. For municipal animal control and community service officers, the employer may pay the difference between the contribution required by W.S. 9 ‑ 3 ‑ 412(a) and the contribution required by this section. For municipal animal control and community service officers, if the employer does not pay the difference between the contribution required by W.S. 9 ‑ 3 ‑ 412(a) and the contribution required by this section, the municipal animal control or community service officer shall pay the amount. Payments under this subsection shall be made monthly to the account in accordance with W.S. 9 ‑ 3 ‑ 413 and are subject to the penalties imposed under W.S. 9 ‑ 3 ‑ 413 for delinquent contributions. No additional contribution shall be imposed upon the state, any city, town or county for benefits provided law enforcement officers under this article. Section 2. (a) Each employer with animal control or community service officers covered under the Wyoming retirement system shall on or before June 30, 2005: (i) Pay amounts necessary to the retirement account for maintaining the actuarial integrity of the account and funding all liability arising from transferring its covered animal control or community service officers to the retirement system for coverage under W.S. 9 ‑ 3 ‑ 432, or for expanding retirement system coverage under W.S. 9 ‑ 3 ‑ 432, as of the date of entry into the system or expansion of coverage, as applicable; (ii) Transfer the covered animal control or community service officers for coverage under W.S. 9 ‑ 3 ‑ 432 or ensure retirement system coverage for its animal control and community service officers under W.S. 9 ‑ 3 ‑ 432, as applicable, as of the date of entry or expansion of coverage. (b) Coverage of animal control and community service officers under W.S. 9 ‑ 3 ‑ 432 shall not be implemented by the Wyoming retirement board until funds payable to the Wyoming retirement system are received as required by this section for deposit into the retirement account, as necessary for maintaining the actuarial integrity of the account and funding all liability arising under this act, for years of service prior to the date of entry or expansion of coverage. (c) In addition to subsection (b) of this section, coverage of animal control and community service officers under W.S. 9 ‑ 3 ‑ 432 shall not be implemented by the Wyoming retirement board until funds necessary for maintaining the actuarial integrity of the account and funding any liability arising under this act, are deposited into the Wyoming retirement account, and contributions required under W.S. 9 ‑ 3 ‑ 432(a) and (b) are paid to the Wyoming retirement system for deposit into the retirement account for at least two (2) months of covered service following the date of entry or expansion of coverage, as applicable. Section 3. This act is effective July 1, 2005. (END) 1 HB0229
