AN ACT relating to water development; providing for certain water development debt service accounts as specified; providing for funding procedures for the accounts; providing for the deposit of certain revenues; and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

Section 1.

1001(a) by creating a new paragraph (vi), (c), (e) and by creating a new subsection (j) is amended to read:

Creation; use of funds; interest.

(a)

The following accounts are created within the debt service fund:

High Savery reservoir account.

(c)

The Wyoming water development commission shall annually review the accounts created by subsection (a) of this section and report to the joint agriculture, public lands and water resources interim committee in the report required under W.S. 41

118(a) the amount of funds in any account which are in excess of that amount needed to meet obligations specified in subsections (d) through
(h)
(j)
of this section.
Funds in excess of the amount needed to meet obligations specified in subsection (d) through (j) of this section shall be deposited in water development account I created by W.S. 41
‑
2
‑
124(a)(i).

(e)

All revenues received by the state from the lease, sale, assignment or transfer of ownership of power or water resulting from the state's interest in the Buffalo Bill dam shall be deposited in the account created by paragraph (a)(ii) of this section. The Wyoming water development commission shall use any monies in the account to meet the
loan,
operation, maintenance and replacement obligations of the state relating to the Buffalo Bill dam project.
Any balance in the account created by paragraph (a)(ii) of this section in excess of five hundred thousand dollars ($500,000.00) or the amount necessary to meet operation, maintenance and replacement obligations related to the Buffalo Bill dam project, whichever is greater, may be used to meet the state's annual obligation for any of the projects referenced in subsection (a) of this section.

(j)

All revenues received by the state from the lease, sale, assignment or transfer of ownership of power or water resulting from the state's interest in the High Savery reservoir and dam shall be deposited in the account created by paragraph (a)(vi) of this section. The Wyoming water development commission shall use any monies in the account to meet the operation, maintenance and replacement obligations of the state relating to the High Savery dam and reservoir project.

pletion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constit
