WORKING DRAFT 2005 STATE OF WYOMING 05LSO-0598 HOUSE BILL NO. HB0294 State employees-sick leave reimbursement. Sponsored by: Representative(s) Samuelson, McOmie and Warren and Senator(s) Case and Massie A BILL for AN ACT relating to state employees; authorizing reimbursement for accumulated sick days upon separation from state service as specified; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1. W.S. 9 ‑ 2 ‑ 1022 by creating a new subsection (n) is amended to read: 9 ‑ 2 ‑ 1022. Duties of department performed through human resources division. (n) The state compensation plan shall provide that, upon separation from state employment, a state employee or the beneficiary of a deceased employee shall receive payment, at the employee's rate of pay at separation, for the current balance of unused sick leave not to exceed payment for four hundred eighty (480) hours, subject to subsection (e) of this section. If the employee has participated in the state employees' and officials' group insurance plan for a minimum of ten (10) years, and is participating at the time of separation, any unused sick leave in excess of nine hundred sixty (960) hours shall be treated as converted sick leave and shall be reimbursed by the state by making contributions on behalf of the employee to the state employees' and officials' group insurance plan at the rate of one (1) month's contribution for each sixteen (16) hours of unused sick leave in excess of nine hundred sixty (960) hours until the converted sick leave is exhausted or the employee becomes eligible for Medicare under Title XVIII of the federal Social Security Act, whichever first occurs. The dollar amount for the contribution to the insurance plan shall be equal to a single employee's health insurance payment at the time of the employee's separation. Section 2.
