WORKING DRAFT 2005 STATE OF WYOMING 05LSO-0335 HOUSE BILL NO. HB0302 Hospital employees-participation in state retirement. Sponsored by: Representative(s) Lubnau, Gingery, Slater, Wasserburger and White and Senator(s) Barrasso, Hines and Von Flatern A BILL for AN ACT relating to the Wyoming retirement system; allowing county and special district hospitals to participate in the retirement system; amending a definition; conditioning implementation upon receipt of required payments; providing for funding; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1. W.S. 9 ‑ 3 ‑ 402(a)(vi)(B) is amended to read: 9 ‑ 3 ‑ 402. Definitions. (a) As used in this article: (vi) "Employer" or "participating employer" means: (B) Any county, except county memorial hospitals or hospital, special hospital districts district , city or town or legally constituted department designated to the board by the appropriate governing body as an employer under this article; Section 2. W.S. 9 ‑ 3 ‑ 402(a)(vii)(F)(III) is repealed. Section 3. (a) Coverage of county hospital or special hospital district employees as authorized under section 1 of this act shall not be implemented by the Wyoming retirement board until funds payable to the Wyoming retirement system are received for deposit into the retirement account, as necessary for maintaining the actuarial integrity of the account and funding all liability arising under this act, for years of service prior to the date of entry or expansion of coverage. (b) Prior to January 1, 2006, any hospital employee shall elect to participate in either the retirement plan offered by the employing institution or the Wyoming retirement system. Each employee shall prior to January 1, 2006, provide written notice to the employing institution and the Wyoming retirement board of his election under this subsection. If an employee fails to notify the employing institution which retirement plan he selects, the institution shall notify the retirement board of this omission and the retirement board shall serve notice on the employee by registered mail return receipt requested that participation in the Wyoming retirement system was not selected. All retirement contributions made on and after January 1, 2006, by any employee, together with matching employer contributions on his behalf, shall be made to the elected plan. An election pursuant to this subsection is irrevocable during the remainder of an employee's working career as an employee. Section 4. This act is effective July 1, 2005. (END) 1 HB0302
