A BILL

for

A JOINT RESOLUTION proposing to modify the state elected officers by making the Wyoming attorney general an elected state officer.

BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF WYOMING,
two-thirds of all the members of the two houses, voting separately, concurring therein:

Section 1.

The following proposal to amend Wyoming Constitution, Article 4, Sections 11 and 12 and to repeal Wyoming Constitution, Article 4, Section 13 is proposed for submission to the electors of the State of Wyoming at the next general election for approval or rejection to become valid as a part of the Constitution if ratified by a majority of the electors at the election:

Article 4,

Section 11.

State officers; election; qualifications; terms.

There shall be chosen by the qualified electors of the state at the times and places of choosing members of the legislature, a secretary of state, auditor, treasurer, and superintendent of public instruction,
and attorney general,
who shall have attained the age of twenty-five (25) years respectively, shall be citizens of the United States, and shall have the qualifications of state electors.
In addition to the foregoing qualifications, the attorney general shall be a member of the Wyoming state bar and shall have practiced law in the state of Wyoming for at least ten (10) years.
They shall severally hold their offices at the seat of government, for the term of four (4) years and until their successors are elected and duly qualified. The legislature may provide for such other state officers as are deemed necessary.

Article 4, Section 12.

State officers; powers and duties.

The powers and duties of the secretary of state, of state auditor, treasurer

and
superintendent of public instruction
, and attorney general
shall be as prescribed by law.

Section 2.
Article 4, Section 13 is repealed.

Section 3.

That the Secretary of State shall endorse the following statement on the proposed amendment:

The amendment changes the composition of the state constitutional officers by making the Wyoming attorney general an elected state officer rather than the attorney general being appointed by the governor. This amendment also removes the outdated provision of salaries of the governor and the other elected state officers. If adopted, the attorney general would be elected beginning in the 2008 general election.
