A BILL
for
AN ACT relating to law enforcement retirement; authorizing specified employees at state parks and historic sites to participate in the law enforcement retirement system; amending a definition; conditioning implementation upon receipt of required payments and transfer of covered employees as specified; providing an appropriation; and providing for an effective date.

Definitions.

(a)

As used in this article:

(xviii)

"Law enforcement officer" or "officer" means any member who is a county sheriff, deputy county sheriff, municipal police officer, duly authorized investigator of the Wyoming livestock board meeting the specifications of W.S. 7

101(a)(iv)(E),
any superintendent, assistant superintendent or full-time park ranger of any state park or historic site meeting the specifications of W.S. 7-2-101(a)(iv)(G),
investigator employed by the Wyoming state board of outfitters and professional guides meeting the specifications of W.S. 7

101(a)(iv)(J), Wyoming correctional officer, Wyoming law enforcement academy instructor, University of Wyoming campus police officer, detention officer or dispatcher for law enforcement agencies;

Section 2.

(a)

Coverage of superintendents, assistant superintendents or full-time park rangers of state parks or historic sites under W.S. 9

‑
432 as provided by section 1 of this act shall not be implemented by the Wyoming retirement board until funds payable to the Wyoming retirement system are received for deposit into the retirement account, as necessary for maintaining the actuarial integrity of the account and funding all liability arising under this act, for years of service prior to the date of entry or expansion of coverage.

(b)

In addition to subsection (a) of this section, W.S. 9

432, with respect to superintendents, assistant superintendents or full-time park rangers of state parks or historic sites, shall not be implemented by the Wyoming retirement board until funds necessary for maintaining the actuarial integrity of the account and funding any liability arising under this act, are deposited into the Wyoming retirement account by the Wyoming department of state parks and cultural resources, and contributions required under W.S. 9
‑
3
‑
432(a) and (b) are paid to the Wyoming retirement system for deposit into the retirement account for at least two (2) months of covered service following the date of entry of coverage, as applicable.

Section 3.
There is appropriated three hundred fifty thousand dollars ($350,000.00) from the general fund to the department of state parks and cultural resources to be deposited in the retirement account as required by section 2 of this act to fund the liability arising under this act for the coverage of superintendents, assistant superintendents and full-time park rangers of state parks or historic sites as provided in section 1 of this act.

Section 4.

This act is effective July 1, 2005.
