AN ACT relating to the Medical Assistance and Services Act; amending eligibility criteria for buy-in under the work incentives improvement option as specified; requiring reports; providing appropriations; repealing sunset provisions; and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

(a)

The department may amend the state plan for medical assistance and services developed under W.S. 42
‑

‑
104(a)(ii) to allow individuals with
countable
income
or assets
not to exceed
one hundred percent (100%)
three hundred percent (300%)
of the
federal poverty
supplemental security income
level to receive services authorized under W.S. 42
‑
4
‑
103(a), provided that:

Section 2.

On or before October 1, 2005 and 2006, the department shall report to the joint labor, health and social services interim committee and the joint appropriations interim committee on the expenditure of amounts appropriated under this section and provide recommendations on program continuation.

Section 3.
There is appropriated to the department of health for the purposes of this act one hundred thirteen thousand four hundred dollars ($113,400.00) from federal funds and ninety-six thousand six hundred dollars ($96,600.00) from the general fund.

Section 4.

2000 Wyoming Session Laws, Chapter 100, Section 2 and 2002 Wyoming Session Laws, Chapter 31, Section 4 are repealed.

Section 5.

This act is effective July 1, 2005.
