Medicaid school health program.

A BILL

for

AN ACT relating to Medicaid and public school funding; requiring the departments of health and education to jointly develop a management and billing system for the Medicaid school health program as specified; granting rulemaking authority; providing for transfer of Medicaid funds for compensable school health expenditures to the school foundation account; requiring reports; providing an appropriation; and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

Section 1.

(a)

The department of education and the department of health shall cooperate to develop a joint management and billing program to generate Medicaid claims for special education expenditures, subject to the following:

(i)

The program shall be developed, tested and implemented in time for districts to begin using the program to generate Medicaid claims for special education expenditures no later than school year 2006-2007;

(ii)

The program shall use
an internet-based statewide software system
for the management and billing by district personnel of individual education programs and services delivered to special education students;

(iii)

The program and reporting procedures shall be developed in a manner that identifies special education services and related administrative expenses
provided to students enrolled in the Medicaid school health program under W.S. 42

103(xxx)
that are
compensable under the Wyoming Medical Assistance and Services Act;

(iv)

The department of health shall use the information obtained under paragraph (iii) of this subsection, with additional documentation as necessary from the districts, to pay claims for services and administrative costs compensable under the school health program;

(v)

The program and procedures shall provide for the qualification of individual school districts as Medicaid service providers and for payment of approved Medicaid school health claims on a monthly basis by transfer from the department of health to the account established pursuant to W.S. 21

306;

(vi)

The program and procedures shall include adequate security measures to protect the privacy of all students whose information is contained in the system and to appropriately limit users' access to identifying information;

(vii)

The department of education may provide in its rules and regulations that district's reporting pursuant to this subsection also satisfies the district's reporting requirements under W.S. 21
‑

‑
321(d);

(viii)

The department of education and the department of health shall adopt complementary rules and regulations for the joint reporting program and the department of health shall amend the state Medicaid plan and obtain any necessary approval from the federal Centers for Medicare and Medicaid Services;

(ix)

The department of health shall provide monthly reports to the state department of education itemizing the total amount claimed by the districts and reimbursed to the foundation during the previous month for programs and services under the school health program;

(x)

School district administrative expenses connected with billing Medicaid for eligible special education expenses, which are not reimbursed by the federal government, shall be reimbursed in the same manner as other special education expenses.

Section 2.

On or before December 31, 2005, and again on or before December 31, 2006, the department of education and department of health shall report to the joint labor, health and social services interim committee and the joint education interim committee on the implementation status of the program established in Section 1 of this act, any recommended statutory changes, and startup and continuing costs of administering this program.

Section 3.

In addition to any other appropriation to implement the medical assistance and services program, there is appropriated to the department of education for the purposes of implementing the computer program required by this act two million dollars ($2,000,000.00) from the school foundation program account.

Section 4.

No funds appropriated under Section 3 of this act shall be expended without the prior approval of the chief information officer.
