Elements:

Under current law the gasoline tax distribution to the snowmobile trails
program uses a formula based on presumed usage of gasoline by snowmobiles.

The bill modifies the distribution by changing part of the formula to a
factor of the gasoline tax rate multiplied by the number of gallons of gasoline
reported to be used by commercial snowmobiles.
(That part of the formula for noncommercial snowmobiles continues to be
based upon an estimated usage amount.)

Requires commercial snowmobile rental businesses to report to the
department of revenue the number of gallons of gasoline used.

AN ACT relating to gasoline taxes; modifying the gasoline tax distributions for the snowmobile trails program; and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

Distribution.

(c)

The department shall certify to the state treasurer amounts to be credited to appropriate accounts based upon deductions from the taxes collected under this article in the following order:

(ii)

Deduct an amount collected on fuel used in snowmobiles, computed by multiplying the number of snowmobiles for which registration and user fees have been paid during the current fiscal year under W.S. 31

The number of gallons used by commercial snowmobiles shall be reported to the department by all businesses offering commercial snowmobile recreational leasing.

shall be credited to an account within the earmarked revenue fund to be expended by the department of state parks and cultural resources to improve snowmobile trails in Wyoming;

This act is effective July 1, 2006.
