Summary/Major
Elements:

A Law Enforcement Retirement
System was created in 2002, which was in many respects similar to, but separate
from, the Wyoming Highway Patrol, Game and Fish Warden and Criminal
Investigation Retirement System. The new system included individuals who were
certified peace officers, but did not include all POST-certified career
officers.

This bill:

Adds probation and parole
officers who are employed by the Department of Corrections to the definition of
"law enforcement officer", thereby making those individuals eligible
for participation in the Law Enforcement Retirement System;

Specifies coverage of
probation and parole officers under the Law Enforcement Retirement System will
not be implemented until the Wyoming Retirement Board receives funds for
deposit into the account, as necessary to maintain the actuarial integrity of
the system and funding all liability arising from this bill for prior years of
service of the new members;

Requires receipt of funds
equal to contributions for at least 2 months of covered service following date
of entry of coverage for the new members;

Appropriates $2,496,321.00 to
fund the liabilities arising under this bill for coverage of probation and
parole officers employed by the Department of Corrections.

AN ACT relating to law enforcement retirement; authorizing specified employees of the department of corrections to participate in the law enforcement retirement system; amending a definition; conditioning implementation upon receipt of required payments and transfer of covered employees as specified; providing an appropriation; and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

Definitions.

(a)

As used in this article:

(xviii)

"Law enforcement officer" or "officer" means any member who is a county sheriff, deputy county sheriff, municipal police officer, duly authorized investigator of the Wyoming livestock board meeting the specifications of W.S. 7

101(a)(iv)(E), investigator employed by the Wyoming state board of outfitters and professional guides meeting the specifications of W.S. 7

101(a)(iv)(J), Wyoming correctional officer,
probation and parole agent employed by the Wyoming department of corrections,
Wyoming law enforcement academy instructor, University of Wyoming campus police officer, detention officer or dispatcher for law enforcement agencies;

probation and parole agents employed by the Wyoming department of corrections

432 as provided by section 1 of this act shall not be implemented by the Wyoming retirement board until funds payable to the Wyoming retirement system are received for deposit into the retirement account, as necessary for maintaining the actuarial integrity of the account and funding all liability arising under this act, for years of service prior to the date of entry or expansion of coverage.

(b)

In addition to subsection (a) of this section, W.S. 9

432, with respect to
probation and parole agents employed by the Wyoming department of corrections
shall not be implemented by the Wyoming retirement board until funds necessary for maintaining the actuarial integrity of the account and funding any liability arising under this act, are deposited into the Wyoming retirement account by the Wyoming department of corrections and contributions required under W.S. 9
‑

‑
432(a) and (b) are paid to the Wyoming retirement system for deposit into the retirement account for at least two (2) months of covered service following the date of entry of coverage, as applicable.

Section 3.

There is appropriated two million four hundred ninety-six thousand three hundred twenty-one dollars ($2,496,321.00) from the general fund to the department of corrections to be deposited in the retirement account as required by section 2 of this act to fund the liability arising under this act for the coverage of Wyoming probation and parole agents employed by the department of corrections as provided in section 1 of this act.

Section 4.
This act is effective July 1, 2005.
