AN ACT relating to the Wyoming state library; abolishing the state library board; providing conforming amendments; and providing for an effective date.

Federal library funds
.

(a)

With the approval of
T
he director
the state library board
may accept and receive all funds, monies or library materials made available by the federal government for the improvement and development of public library services in the state.

(b)

The state treasurer is custodian of all federal funds allocated to the state for statewide library services and shall disburse the funds on the requisition of
the state library board subject to approval of
the director and subject to other provisions of law.

State librarian; appointment; qualifications; filing of state publications; deposit of designated documents; exchange of session laws.

(a)

A state librarian shall be appointed by the director of the department of administration and information
after consultation with the board
and shall serve as the administrator of the state library division of the department. The state librarian shall have:

The state librarian shall guide local library agencies participating in any state plan
adopted by the board and approved by the director
for the expenditure of any federal funds or materials. The state librarian shall assure compliance with the policies and methods of administration
adopted by the board
under the state plan.

State librarian; acquisition of books and materials; disposition of outdated and unused books; disposition of unused materials and supplies; promulgation of rules.

(a)

With the approval of the director, the state librarian may:

(ii)

Sell outdated and unused books in the collection of the state library when the
board
director

deems the sale necessary due to limited shelf space;

(d)

The department
in consultation with the board
may promulgate necessary rules and regulations to effectuate the purposes of this section.

Department of administration and information created; director appointed; structure.

(b)

The administrative head of the department shall be a director appointed by the governor not later than July 1, 1990. The director shall prepare a plan for reorganization of the agencies, programs and functions specified in this section and submit it to the governor for approval. The department reorganization plan, as approved, shall be submitted to the joint appropriations interim committee and the select management audit committee of the legislature and made available to the public. The committees shall hold at least one (1) public hearing regarding the plan before the 1991 session of the legislature convenes. The select management audit committee shall report its advisory recommendations on the plan to the joint appropriations interim committee, including necessary legislation with respect to the plan. The joint appropriations interim committee shall consider the recommendations and shall report to the legislature by December 1, 1990, its recommendations on the plan, including necessary legislation with respect to the plan. The plan, as approved by act of the legislature, shall be implemented not later than July 1, 1991.
Pending adoption of the plan, the state library, archives, museums and historical board shall have authority within the department of administration for administration of the state library.
