Subject: Creates a "special prosecution account" in the attorney general's office. Summary/Major Elements: Appropriates $300,000.00 to the attorney general for a "special prosecution account." Provides that the account is to be used to assist counties with unusually costly prosecutions, as defined by rules of the attorney general. The funds "shall not be used for expenses of the office of the attorney general." Provides that disbursements are at the discretion of the attorney general upon written request from prosecuting attorneys, who shall submit supporting fiscal information with any request.
WORKING DRAFT ORIGINAL SENATE FILE NO. 0150 ENROLLED ACT NO. 102, SENATE FIFTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING 2005 GENERAL SESSION AN ACT relating to the office of the attorney general; creating a special prosecution account as specified; granting rulemaking authority; providing an appropriation; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1. (a) There is appropriated to the attorney general from the general fund three hundred thousand dollars ($300,000.00) to fund a special prosecution account. (b) The special prosecution account shall be used to assist individual counties in the prosecution of criminal defendants in cases where the extraordinary actual costs of prosecution is unusually expensive, as defined by rules and regulations of the attorney general. (c) Funds in the special prosecution account shall be disbursed at the discretion of the attorney general only after written request of a prosecuting attorney, who shall submit supporting budget information for the prosecutor's actual prosecution expenses along with projected costs of prosecution for the case involved. (d) Funds in the special prosecution account shall not be used for expenses of the office of the attorney general. Section 2. This act is effective immediately upon co m pletion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constit u tion.
