FIFTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING
2005 GENERAL SESSION

AN ACT relating to the national guard youth challenge program; requiring matching funds to secure available federal funds to initiate the program; imposing conditions; delegating duties to the military department and the department of education; providing for reversion of appropriated funds under prescribed conditions; authorizing additional positions; requiring annual reports; and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

Section 1.

(a)

For the period beginning immediately upon the effective date of this act, and ending June 30, 2006, one million one hundred twenty thousand dollars ($1,120,000.00) is appropriated from the school foundation program account to the Wyoming military department for purposes of matching available federal funds for initiating and implementing the national guard youth challenge program in Wyoming. The national guard youth challenge program provides resources to create opportunities and alternatives for youth at risk or who have dropped out of the public school system, ages sixteen (16) to eighteen (18) years, to attain a high school diploma or high school equivalency certification and to develop life skills. The Wyoming department of education shall provide assistance necessary for the provision of educational programs addressing needs of the participating youth and for establishing necessary communications and cooperation with Wyoming school districts.

(b)

Any funds appropriated for the national guard youth challenge program shall be expended only upon receipt of federal matching funds equal to one million six hundred eighty thousand dollars ($1,680,000.00). If by July 1, 2005, federal funds are not available and received at the level specified by this subsection, the funds appropriated under this section shall revert to the school foundation program account.

(c)

Of the amounts appropriated under this section and from available federal matching funds received for this purpose, the Wyoming military department is authorized an additional forty-five (45) full-time positions to implement this act.

(d)

If federal matching funds are received on or before July 1, 2005, the Wyoming military department shall commence necessary expenditures to enable implementation of the youth program by July 1, 2006.

(e)

The Wyoming military department shall provide a report not later than October 1 of each year to the joint appropriations and the joint education interim committees including the following information:

(i)

Yearly enrollment in the national guard youth challenge program in Wyoming;

(ii)

Yearly number of successful completions through the challenge program; and

(iii)

An annual detailed listing of budget expenditures for the challenge program.

Section 2.

This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
