Perpetuities.

A BILL

for

A JOINT RESOLUTION proposing to amend the Wyoming Constitution to allow perpetuities for public purposes.

BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF WYOMING,
two-thirds of all the members of the two houses, voting separately, concurring therein:

Section 1.
The following proposal to amend Wyoming Constitution, Article 1, Section 30 is proposed for submission to the electors of the State of Wyoming at the next general election for approval or rejection to become valid as a part of the Constitution if ratified by a majority of the electors at the election:

Article 1, Section 30.

Monopolies prohibited; perpetuities restricted.

Perpetuities and
M
onopolies are contrary to the genius of a free state, and shall not be allowed. Corporations being creatures of the state, endowed for the public good with a portion of its sovereign powers, must be subject to its control.
Perpetual contracts shall not be allowed except in a manner specified by law. Such perpetuities shall be limited to the preservation of public spaces and wildlife habitat, and such other public purposes as provided for by the legislature.

Section 2.
That the Secretary of State shall endorse the following statement on the proposed amendment:

The adoption of this amendment would allow the Legislature to enact laws allowing for perpetual contracts for public purposes.
