A BILL

AN ACT relating to insurance; prohibiting clauses in insurance policies excluding coverage for losses caused by the insured's being intoxicated or under the influence of drugs; repealing a provision authorizing alcohol exclusion clauses in disability policies; and providing for an effective date.

Intoxication exclusion clauses; prohibition.

No policy or certificate of insurance that is
delivered, issued for delivery, or renewed in this state after June 30, 2006,
including those issued by a health maintenance organization authorized pursuant to chapter 34 of this title,
shall exclude the
payment of benefits for injuries sustained by any person because the insured or certificate holder was under the influence of alcohol or drugs.

Nothing in this section precludes an insurer from excluding coverage for any claim arising from the commission of a felony.
