AN ACT relating to minors and alcoholic beverages; specifying penalties for minors purchasing or attempting to purchase alcohol; providing for driver's license suspension as specified; and providing for an effective date.

Section 1.

128 by creating a new subsection (n) are amended to read:

Sale
or possession prohibited; when possession unlawful; public drunkenness; falsification of identification; penalty; prima facie identification as defense.

(c)

Any person under the age of twenty-one (21) years who attempts in any manner to purchase alcoholic or malt beverages or who falsifies any identification or uses any false identification in order to obtain alcoholic or malt beverages is guilty of a misdemeanor.
If it has been determined by the jury, or a judge in a nonjury trial, that a motor vehicle was used by a minor to facilitate the offense, the judge may order a copy of the minor's record of conviction under this subsection to be forwarded to the department of transportation with a recommendation for suspension of the minor's license or permit. The department of transportation shall then suspend the minor's driver's license or permit in accordance with W.S. 31

128(n). Any driver's license or permit suspension as a result of a conviction under this subsection shall not be the basis for any increase in insurance premiums or the cancellation of any insurance policy for a minor, his parents or guardian.

Mandatory suspension of license or nonresident operating privilege for certain violations; suspension of registration.

(n)

Upon receiving a record of the licensee's conviction under W.S. 12

101(c) with a recommendation of suspension by the court, the division shall suspend a license or permit of the driver as follows:

(i)

For a period of ninety (90) days for a first offense of W.S. 12

101(c);

(ii)

For a period of six (6) months for a second offense of W.S. 12

‑
101(c);

(iii)

For a period of one (1) year for a third or any subsequent conviction of W.S. 12

101(c).

Section 2.

This act is effective July 1, 2006.
