Recruitment bonus plan established.

The
Wyoming
national guard recruitment referral bonus plan is established to pay qualified members of the
Wyoming
national guard a bonus for referring to a
Wyoming
national guard recruiter an eligible enlistee who enlists in the
Wyoming
national guard. The plan shall be administered by the adjutant general in accordance with the provisions of this article. The adjutant general shall promulgate rules for the administration, implementation and proper utilization of the plan.

Definitions.

(a)

As used in this article:

(i)

"Eligible enlistee" means a person who has not been a member of the
Wyoming
national guard during the six (6) months before the date of referral;

(ii)

"Qualified member" means an active member in good standing of the Wyoming national guard, but does not include those members described in W.S. 19-9-603(b).

Requirements for premium reimbursement.

(a)

Subject to legislative appropriation and in accordance with the provisions of this article, the adjutant general or his designee, may authorize the payment of a referral bonus, to a qualified member, subject to the following:

(i)

The qualified member refers an eligible enlistee to a
Wyoming
national guard recruiter after May 1, 2006;

(ii)

The eligible enlistee confirms in writing that the qualified member referred the enlistee to the recruiter;

(iii)

The eligible enlistee enters into service with the
Wyoming
national guard within ninety (90) days of the referral by the qualified member;

(iv)

The eligible enlistee has successfully completed basic training during a previous enlistment or the new enlistment.

(b)

Members of the
Wyoming
national guard who hold recruiting or retention assignments are not eligible to receive a recruiting bonus. In addition, the adjutant general may designate additional persons by rank, position or assigned duties who are ineligible for a referral bonus.

(c)

Referral bonuses shall not be shared with the eligible enlistee but may be shared with other members of the
Wyoming
national guard as provided in the department's rules and regulations.

(d)

Referral bonuses to any one
(1)
qualified member under this article shall not exceed five hundred dollars ($500.00) for the first eligible enlistee referred and two hundred fifty dollars ($250.00) for each subsequent eligible enlistee referred.

(e)

Any dispute concerning the payment of a referral bonus is not subject to the provisions of the Wyoming Administrative Procedure Act and shall be resolved in the sole discretion of the adjutant general or his designee.

Referral bonus not a bounty.

Payment of a referral bonus pursuant to this article shall not be construed as a bounty for purposes of 10 U.S.C.
§
5149(a).

Section 2.

Four hundred fifty thousand dollars ($450,000.00) is appropriated from the general fund to the military department for the payment of referral bonuses as provided by this act.
