WORKING DRAFT 2006 STATE OF WYOMING 06LSO-0140 HOUSE BILL NO. HB0030 Intentional feeding of game animals. Sponsored by: Joint Travel, Recreation, Wildlife and Cultural Resources Interim Committee A BILL for AN ACT relating to big and trophy game animals; prohibiting intentional and negligent feeding of big and trophy game animals; providing exceptions; providing definitions; providing penalties; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. W.S. 23 ‑ 3 ‑ 309 is created to read: 23 ‑ 3 ‑ 309 Intentional feeding of big and trophy game animals; penalty. (a) No person shall intentionally attract or feed any big game or trophy game animal by depositing, placing, distributing or scattering any attractant or food source. (b) No person, after having received a written warning from the department or any peace officer as defined in W.S. 7 ‑ 2 ‑ 101(a)(iv), shall fail to properly store any attractant or food source or otherwise allow big or trophy game animals to have access to an attractant or food source. (c) Nothing in this section shall prohibit: (i) Any normal or accepted agricultural management practice; (ii) Any big game animal or trophy game animal feeding program authorized or conducted by the department; (iii) Any legal form of taking big game or trophy game animals as provided in W.S. 23 ‑ 1 ‑ 705(j) or baiting trophy game animals as authorized by commission rule and regulation. (d) As used in this section: (i) "Attractant or food source" means salt, hay, grain, fruit, nut, chemical, mineral, garbage or other substance or material used as an attraction, food source or enticement for big game or trophy game animals, regardless of the kind and quantity; (ii) "Properly store" means to store in such a manner that a reasonable and prudent person would believe the attractant or food source had been secured in a manner to prohibit access by big or trophy game animals. (e) A violation of this section constitutes a 5 th degree misdemeanor. Section 2. This act is effective July 1, 2006. (END) 1 HB0030
