WORKING DRAFT 2006 STATE OF WYOMING 06LSO-0271 HOUSE BILL NO. HB0052 Military department real property purchase. Sponsored by: Representative(s) Walsh, Bagby, Davison, Edwards, Esquibel, Gay, Illoway, Pedersen, Powers and Slater and Senator(s) Cooper and Jennings A BILL for AN ACT relating to the military department; authorizing the purchase of real property for use by the military department; specifying requirements for purchase; requiring reports; providing an appropriation; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. Upon approval by the governor and subject to the provisions of this act, the adjutant general may purchase in the name of the Military Department of the State of Wyoming , real property in the vicinity of Camp Guernsey , Wyoming . Section 2. (a) The military department shall identify land in the area of Camp Guernsey , Wyoming , that if purchased by the Wyoming military department, would increase the capabilities of Camp Guernsey as a military training and operations site or protect Camp Guernsey from private or public encroachment that may inhibit future military use. (b) The military department shall assess the utility of any real property identified under subsection (a) of this section , and may negotiate accordingly for the purchase of any identified real property. (c) Prior to purchasing any real property as authorized by this act, the military department shall obtain an appraisal of the real property from a Wyoming certified general appraiser, and shall consider the appraisal value prior to purchasing any real property under this act. (d) T he military department shall obtain a mineral title report prior to purchasing any real property under this act , and shall obtain a title insurance commitment prior to concluding closing proceedings of any purchase. (e) The military department shall report any actions taken under this act to the governor and to the joint transportation, highways and military affairs interim committee not later than September 1, 2007. The military department shall report any purchase under this act to the joint transportation, highways and military affairs interim committee within thirty (30) days after closing on any real property. Section 3. There is appropriated t en million dollars ($10,000,000.00) from the budget reserve account to the military department for the purposes of this act. This funding may be used for the actual purchase of real property, as well as for administrative expenses related to any real property purchase including environmental management and infra-structure requirements for initial military use. Funds not expended or obligated in accordance with this act shall lapse as provided by W.S. 9 ‑ 4 ‑ 207(c) on June 30, 2008. Section 4. This act is effective immediately upon co m pletion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constit u tion. (END) 1 HB0052
