AN ACT relating to crimes and offenses; prohibiting hazing as specified; providing a definition; providing penalties; and providing for an effective date.

Hazing prohibited; definition; penalty.

(a)

No person shall intentionally haze or conspire to haze any member, potential member or person pledged to be a member of any organization in a school, college, university or other educational institution in this state, as a condition or precondition of attaining membership in the organization or of attaining any office or status therein.

(b)

As used in this section, "haze" means to subject a person to mental or psychological harm, bodily danger or bodily injury or a likelihood of mental or psychological harm, bodily danger or bodily injury, or to require, encourage, authorize or permit that the person be subjected to mental or psychological harm
,
bodily danger or bodily injury.

(c)

Any person who intentionally hazes another person is guilty of a:

(i)

Misdemeanor if the act results in
mental or psychological harm or
bodily injury to another, punishable by imprisonment for not more than six (6) months, a fine of not more than seven hundred fifty dollars ($750.00), or both;

(ii)

Felony if the act results in
serious mental or psychological harm or
serious bodily injury or death to another, punishable by imprisonment for not more than ten (10) years, a fine of not more than ten thousand dollars ($10,000.00), or both.

Section 2.
This act is effective July 1, 2006.
