AN ACT relating to
Drug Abuse Resistance Education (D.A.R.E.)
programs; providing for grants to
law enforcement agencies
; providing for rules and regulations; providing an appropriation; and providing for an effective date.

Section 1.

program grants; disbursement of grants.

(a)

There is created the
Drug Abuse Resistance Education (D.A.R.E.)
program grant account.

(b)

The department of health, substance abuse division, shall approve criteria for grant applications by
law enforcement agencies
, through rules and regulations promulgated by the department, to meet the following public purposes:

(i)

To pay for training of
law enforcement
officers as
Drug Abuse Resistance Education (D.A.R.E.)
program teachers;

(ii)

To pay for materials necessary for the teaching of
Drug Abuse Resistance Education (D.A.R.E.)
programs;

(iii)

To pay for other costs of administering
, evaluating and supporting

Drug Abuse Resistance Education (D.A.R.E.)
programs within the
state
.

(c)

From the funds available in the
Drug Abuse Resistance Education (D.A.R.E.)
program grant fund, the department of health, substance abuse division may award grants to
law enforcement agencies
in this state to support the purposes specified in subsection (b) of this section and using the following criteria:

(i)

Consideration of the number of people served by the
Drug Abuse Resistance Education (D.A.R.E.)
program;

(ii)

Consideration of the cost to
provide or
implement the
Drug Abuse Resistance Education (D.A.R.E.)
program;

(iii)

The availability of other funding sources.

(
d
)

The department of health, substance abuse division shall promulgate reasonable rules and regulations in accordance with the Wyoming Administrative Procedure Act to implement the grant program and to review and monitor the expenditure of monies awarded as provided in subsection (b) of this section.

(e)

As used in this section, "law enforcement agency" means a public agency having police power, charged with enforcing state criminal statutes or municipal ordinances and employing law enforcement personnel qualified pursuant to W.S. 9

Section 2.

Two hundred thousand dollars ($200,000.00) is appropriated for fiscal years 2007
and
2008 from the general fund to the
Drug Abuse Resistance Education (D.A.R.E.)
program grant account created in section 1 of this act for purposes of funding grants under W.S. 35

Section 3.

This act is effective July 1, 2006.
