Excess funds account.

AN ACT relating to public funds; creating an excess funds account; making an appropriation of funds to the account; specifying intent; and providing for an effective date.

Be It Enacted by the Legislature of the State of
Wyoming
:

Section 1.

(a)

There is created an excess funds account in anticipation of the passage of 2006 House Joint Resolution 1, authorizing the expenditure of excess state funds to the citizens of the state pursuant to Article 16, Section 6 of the Wyoming Constitution. Any earnings from investment of monies in the account shall be credited by the state treasurer to the account.

(b)

There is appropriated from the budget reserve account and the general fund to the excess funds account created by this act one billion dollars ($1,000,000,000.00). This appropriation to the excess funds account shall be made as soon as funds are determined to be available under the provisions of this section for the fiscal biennium ending June 30, 2008. The appropriation under this section shall be made from unexpended, unappropriated and unencumbered balances within the budget reserve account. To the extent funds within the budget reserve account are insufficient to fulfill the appropriation as specified, then funds within the general fund which are unexpended, unappropriated and unencumbered shall be used to fulfill the balance of the appropriation under the terms specified.

Section 2.
This act is effective July 1, 2006.
