WORKING DRAFT 2006 STATE OF WYOMING 06LSO-0477 HOUSE BILL NO. HB0189 Energy transmission infrastructure account. Sponsored by: Representative(s) Philp, Berger, Cohee, Lockhart and Luthi and Senator(s) Hawks A BILL for AN ACT relating to economic development; creating an energy transmission infrastructure account within the revolving investment fund created under A rticle 16, S ection 12 of the Wyoming C onstitution; providing an appropriation to the account; providing for loans from the account; providing for repayment of loans; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming , two-thirds of all the members of the two houses, voting separately, concurring therein : Section 1. There is appropriated from the general fund ten million dollars ($10,000,000.00) to the energy transmission infrastructure account, hereby established within the revolving investment fund created under A rticle 16, S ection 12 of the Wyoming C onstitution. Section 2 . The state treasurer is authorized to loan from the energy transmission infrastructure account, to any enterprise proposing the development of any energy transmission project which will employ people within the state, provide services within the state, use resources within the state or otherwise add economic value to natural resources produced in the state , up to ten million dollars ($10,000,000.00) for purposes of developing the energy transmission project. No funds shall be loan ed until the loan has been approved by a unanimous vote of the five (5) members of the state loan and investment board. Monies loaned under this section shall be repaid, with interest at an annual rate set by the state loan and investment board of not more than four percent (4%), to the energy transmission infrastructure account at such time and manner as the board determines, but the funds shall be repaid in any event not later than ten (10) years after the loan is made . Upon repayment of loans to the account , monies within the account may be loaned under the same conditions to other entities for energy transmission development projects meeting the requirements of Article 16, Section 12 of the Wyoming Constitution. A loan agreement shall be prepared and approved by the attorney general before distribution of loan proceeds. Section 2 . This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution. (END) 1 HB0189
