WORKING DRAFT 2006 STATE OF WYOMING 06LSO-0452 HOUSE JOINT RESOLUTION NO. HJ0006 School finance-recapture limitation-2. Sponsored by: Representative(s) Wasserburger A BILL for A JOINT RESOLUTION proposing to amend the Wyoming Constitution ; relating to the recapture of school district tax revenues for the support of public schools ; providing for recapture and distribution of a portion of funds not currently subject to recapture . BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF WYOMING , two-thirds of all the members of the two houses, voting separately, concurring therein: Section 1. The following proposal to amend Wyoming Constitution, Article 15 , Section 17 is proposed for submission to the electors of the State of Wyoming at the next general election for approval or rejection to become valid as a part of the Constitution if ratified by a majority of the electors at the election: Article 15, Section 17. County levy for support and maintenance of public schools. (a) There shall be levied each year in each county of the state a tax of not to exceed six mills on the dollar of the assessed valuation of the property in each county for the support and maintenance of the public schools. This tax shall be collected by the county treasurer and disbursed among the school districts within the county as the legislature shall provide. The legislature may authorize boards of trustees of school districts to levy a special tax on the property of the district. The legislature may also provide for the distribution among one or more school districts of not more than three-fourths of any revenue from the special school district property tax in excess of a state average yield, which shall be calculated each year, per average daily membership , . and further provided the amount in excess of the three-fourths limitation shall be subject to the following: (i) Twenty-five percent (25%) of the excess amount shall remain with the district in which the tax revenues originated, which district shall be considered an im pacted district; and (ii) The remainder shall be distributed among school districts in a proportion equal to the prior fiscal year's distribution of state fund s supporting public schools . The revenue distributions under this paragraph shall not be considered in determining distributions of state funding to school districts . Section 2. That the Secretary of State shall endorse the following statement on the proposed amendment: The adoption of this amendment will allow impacted school districts to retain a lesser portion of school district tax revenues . Resulting excess amounts will be distribute d to school districts across the state. These additional revenues will be in addition to school funds otherwise provided by the state. (END) 1 HJ0006
