WORKING DRAFT 2006 STATE OF WYOMING 06LSO-0273 SENATE FILE NO. SF0026 Eminent domain moratorium. Sponsored by: Joint Agriculture, Public Lands and Water Resources Interim Committee A BILL for AN ACT relating to eminent domain; creating a moratorium on certain eminent domain actions; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. Notwithstanding any provision of law, until further enactment by the legislature, the state, any state agency, any state political subdivision or any other entity authorized to use eminent domain shall not initiate or pursue condemnation or eviction actions under W.S. 1 ‑ 26 ‑ 501 through 1 ‑ 26 ‑ 817 when the taking will result in the property being owned or controlled by a private party. This prohibition shall not apply to the use of eminent domain for the taking of private property pursuant to W.S. 24 ‑ 9 ‑ 101 through 24 ‑ 9 ‑ 104, or to be used by a common carrier or public utility. This moratorium includes, but is not limited to, all proceedings currently in progress on the effective date of this act. Section 2. This act is effective immediately upon co m pletion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constit u tion. (END) 1 SF0026
