FIFTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING
2006 BUDGET SESSION

AN ACT relating to the department of agriculture; creating a task force to study bio-security laboratory issues, needs and coordination in Wyoming and among various state and federal agencies; requiring a report; providing an appropriation; and providing for an effective date.

Be It Enacted by the Legislature of the State of Wyoming:

Section 1.

(a)

There is created an executive task force to study Wyoming bio-security laboratory issues and coordination between Wyoming and other state and federal agencies.

(b)

The task force shall be comprised of:

(i)

The governor, or his designee;

(ii)

The director of the Wyoming department of agriculture, who shall be the chairman of the task force;

(iii)

A representative of the Wyoming board of agriculture, appointed by the chairman of the Wyoming board of agriculture;

(iv)

A representative of the Wyoming department of game and fish, appointed by the director of the Wyoming department of game and fish;

(v)

A representative of the Wyoming livestock board, appointed by the chairman of the Wyoming livestock board;

(vi)

A representative of the Wyoming department of environmental quality, appointed by the director of the Wyoming department of environmental quality;

(vii)

A representative of the Wyoming department of health, appointed by the director of the Wyoming department of health;

(viii)

A representative of the Wyoming office of homeland security, appointed by the director of the Wyoming office of homeland security; and

(ix)

A representative of the University of Wyoming, appointed by the president of the University of Wyoming.

(c)

The task force shall:

(i)

Consult with the United States department of agriculture/agriculture research service arthropod-borne animal diseases research laboratory;

(ii)

Familiarize itself with the various governmental jurisdictions, regulations and homeland security requirements of a bio-security laboratory;

(iii)

Conduct a comprehensive review of other state and federal collaborative bio-security laboratories to determine structural and fiscal potentials or constraints;

(iv)

Consider current limitations of other state bio-security laboratories, overlapping uses, possible jurisdictional gaps and requisite autonomies of each bio-security laboratory;

(v)

Consider advantages of collaborative uses of joint structures.

(d)

The task force may contract with a consultant to assist in the facilitation of the task force duties and may consult with any other state, local or federal agencies, public or private stakeholders as the task force deems appropriate.

(e)

The task force shall disseminate requests, including through electronic media, for the active participation of private groups and organizations in the study.

(f)

No later than September 1, 2006, the task force shall submit a report to the joint agriculture, public lands and water resources interim committee. The report shall detail the task force's findings, recommend any preferable alternatives together with any advantages and disadvantages of each alternative, and recommend any statutory changes that may be required to implement the task force's final recommendations.

(g)

Staff support for the task force shall be provided by the Wyoming department of agriculture and by any state agency upon request.

(h)

In addition to the appropriation contained in section 2 of this act, the Wyoming department of agriculture may utilize existing resources and apply for any federal or private grants that may be available to augment funding for the task force study and report required under this act.

(j)

This act shall terminate April 1, 2007.

Section 2.

There is appropriated from the general fund to the Wyoming department of agriculture one hundred thousand dollars ($100,000.00) to fund interim meetings and activities of the task force and to contract with appropriate professionals as necessary to complete the duties assigned to the task force in section 1 of this act.

pletion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constit
