Provides for a new full-time position for a director of the livestock board who serves at the pleasure of the state veterinarian. Provides for deputy state veterinarians to serve at the pleasure of the state veterinarian. Provides for deputy directors to serve at the pleasure of the director. Provides an appropriation of $221,500.00 from the general fund.
WORKING DRAFT ORIGINAL SENATE FILE NO. 0034 ENROLLED ACT NO. 61, SENATE FIFTY-EIGHTH LEGISLATURE OF THE STATE OF WYOMING 2006 BUDGET SESSION AN ACT relating to the Wyoming livestock board; modifying the structure and powers of the board; authorizing a position of director of the agency under the direction of the state veterinarian; modifying duties; providing an appropriation; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming : Section 1. W.S. 11 ‑ 18 ‑ 101(a), 11 ‑ 18 ‑ 103(a) , (ii) (intro) , (A), (iii) and (iv) and 11 ‑ 18 ‑ 110 are amended to read: 11 ‑ 18 ‑ 101. Livestock board; creation; composition; qualifications; appointment and term of members; removal; vacancies; name defined. (a) The Wyoming livestock board is created and shall consist of three (3) woolgrowers and four (4) stockmen engaged in other seven (7) livestock interests producers . At least three (3) members shall be sheep producers and at least three (3) shall be cattle producers, provided that if a vacancy exists on the board and no person meeting all the qualifications of this section is available then any livestock producer within the appointment district may be appointed. They Members shall be appointed by the governor with the advice and consent of the senate and may be removed by the governor as provided in W.S. 9 ‑ 1 ‑ 202. The members shall be appointed from each of the appointment districts pursuant to W.S. 9 ‑ 1 ‑ 218 and the appointment for each district shall be rotated among the counties within the district. The members shall serve for one (1) six (6) year term and until their successors are appointed and qualified. In case of a vacancy for any reason, the governor shall appoint a qualified person to fill the vacancy in accordance with W.S. 28 ‑ 12 ‑ 101. Each member of the Wyoming livestock board shall be a qualified elector of the county from which he is appointed and a resident of this state during his term of office. 11 ‑ 18 ‑ 103. Livestock board; powers generally. (a) In addition to powers and duties hereinafter provided, the Wyoming livestock board may: (ii) And shall, in consultation with the state veterinarian, appoint a director . The board, in consultation with the state veterinarian, may a ppoint deputy state veterinarians . , a gents and assistants who The director and any deputy state veterinarians shall act under the direction of the Wyoming livestock board and its chief executive officer : (A) Deputy state veterinarians must shall be graduates of a veterinary college recognized by the American Veterinary Medical Association and the state board of veterinary medicine. Deputy state veterinarians shall serve at the pleasure of the state veterinarian. (iii) Supervise and control the action of its chief executive officer, all deputies and other employees the state veterinarian and prescribe their his duties and tenure of office; (iv) Remove any of its appointees, subordinates or employees the state veterinarian at any time ; for cause; 11 ‑ 18 ‑ 110. Director; deputy directors; term; powers and duties generally; orders subject to review. (a) The chief executive officer director shall serve at the pleasure of the chief executive officer and act as the secretary of the Wyoming livestock board, subject to the rules and regulations of the board. He may act for and perform the duties imposed by law upon the board when the board is not in session, but an order or regulation made by him is subject to review, modification or annulment by the board at any subsequent meeting. (b) The director may appoint deputy directors for agency divisions. The deputy directors shall serve at the pleasure of the director and are responsible to and under the control and supervision of the director . (c) The director shall s upervise and control the action of the other employees and prescribe their duties and tenure of office. (d) Unless otherwise specified in this chapter, the director may only remove employees in accordance with personnel rules of the state executive branch. Section 2. There is appropriated from the general fund to the livestock board two hundred twenty-one thousand five hundred dollars ($2 21 ,500.00) for the biennium to fund the director position pursuant to this act. There is authorized one (1) full-time equivalent position for the position of director authorized by this act. Section 3. This act is effective July 1, 2006.
