This bill clarifies that:

Judges appointed prior to July 1, 1998 and those who are currently
receiving retirement benefits under Title 5 of the Wyoming Statutes are subject
to the judicial retirement system created under Title 5;

Judges and justices appointed on or after July 1, 1998, are subject to
the retirement system created under Title 9 of the Wyoming Statutes.

Comments:

In 1998, the Legislature created a new retirement system for judges and
justices.

The existing language in W.S.
5-1-106 was confusing to potential applicants for judicial vacancies because
some applicants did not understand which judicial retirement system would apply
to them.

This section shall apply to judges who
were appointed prior to July 1, 1998 and to judges who
