Section 1.

Collection of contributions and benefit overpayments; procedures.

(a)

The department shall institute such practices and procedures as it deems necessary to collect any money due the department in the form of delinquent employer contributions, or overpaid benefits, including all penalties and interest thereon. In the case of the overpayment of benefits, W.S. 27

409 shall apply.

(b)

If the department determines an employer account is uncollectible, the account may be referred to a

licensed
private collection agency for collection. Reasonable fees for collection may be collected in addition to the amount of the debt. The debtor shall be liable for the repayment of the total amount outstanding plus the collection fee.

(c)

If, after due notice, any employer or individual receiving benefits under this act defaults in any payment of contributions or repayment of overpaid benefits or the payment of any interest or penalties due thereon, the amount due may be collected by civil action, which shall include the right of attachment in the name of the department. Court costs shall not be charged to the department, but any employer or individual receiving benefits under this act against whom judgment is taken shall be
charged
with all costs in such action
.

This act is effective July 1, 2006.
